A Question About Will Preparation And Estate Planning?

My dad passed away last year Feb and left a will. On the will my dad left me and my younger brother a house that is rented out. My mom and sister is taking care of the house rent and repairs. Because my mom is still alive does she have the right to have rights to this house as long as she lives? She will respectfully fulfill the will of my dad but as long as she lives I don’t have a problem with her collecting the rent and managing the property.

My other brother seems to think that she owes him 1 2 the rent collected a year ago. Does he have that right? Shouldn’t the widow have rights to everything even though my dad left the kids property while she is alive in case she needs it and then when she passes away his and her Wills will be executed? Please help.

What Forms Are Needed For Estate Planning For A US citizen Abroad?

My father has land in Asia under his name and recently passed away, in order to transfer ownership to my mother. Does anyone know what forms I would need to do this? Other than bringing proof that he is my father, land deed and new person’s ID.

As I collect more assets I have begun to think about estate planning. What happens when I die and I have a will done by an estate company.. If I say all the assets money property stocks goes to my children 50 50 will the will even need to go to court? If I say they need to be at least 25 years old to get their share and they are older than 25 how to they actually get it? I mean literally how are shares and mutual funds split 50 50? Who at court does this and if I were to die, who would my family call to get this process started? Thanks.

What Is The Difference Between A Wills & Probate Lawyer Versus A Family Law Lawyer??

My family members are In the beginning of settling an estate …What is the difference between a wills & probate lawyer versus a family law and divorce lawyer…A brother who CLAIMS to be in charge of the estate sent paper work to me ….I looked up the lawyer he hired and the lawyer is called a Family law and divorce lawyer…….The type attorney I need to hire to settle quit claim deeds and repairs and upgrades made to the property left to the family is a Probate and will lawyer…Correct??..This brother who on the death of my mother DID NOT give a reading of the will and also DID NOT send any of the 6 kids a copy of her will…He is now demanding over $10000 in back taxes our mom paid already as well as repairs he made when he was given power of attorney to manage the property. He consulted nobody else on the deed about this….He is now going after everyone by the throat to cough up $2000 $3000 in 10 days OR ELSE…Is it a Wills and probate lawyer we contact??

How Long To Receive Legacy Left To Me In A Will?

My sister was left all my mums assets and property .she was also the executer of the will .a modest legecy was left to me and my daughter in the will. How long before she has to settle these? She may be keeping the property to rent out and sell in the future as retirement fund.can’ t ask sister as we are currently not on speaking terms.

Missing Will, Probate And An Evil Cousin….. Help!!?

My Grandpa passed on the 15th October, he has savings and property which he said was left to me in his will. Suddenly a long lost nasty cousin has turned up out of the blue saying he is the executor dealing with Grandpas finances and that it has all gone to probate and that he did not leave a will. I believe the cousin stole grandpas keys to the house and car just before Grandpa died, as the car has gone and he is the only one with access to the house. The cousin said he has a meeting with the probate people??? and that I am not to attend, he has now changed his number so I can not contact him, I have no idea what to do now, I have called all the local solicitors who claim they have not got his will but this cousin knows a who, a lot more than I do. Any advice?????
