Probating a will – good idea or let the court settle it?

If one has a will, and dies, and the only details that are in the will are to pass all assets to the survivor, is it worth it to get the will probated, or just not even mess with the will, since the state is going to pass all the assets to the survivor anyway?

mother’s will ask that all assets be divided in even and equal shares, 2 accounts list 1 person as POD, 1 account is divided the other is hidden and refused, now to avoid court money has been offered but at less than current value. Do I have legal recourse to honor mothers will and have all assets shared equally ?

Do I need a probate attorney for this?

I recently married a widow that has an existing valid will, leaving everything to her only child daughter from the first marriage. After four months of marriage, my new wife died before we could revise the original will. Step-daughter has now expressed interest in trying to nullify the original will and making me, the new husband, the sole beneficiary. We have gotten along well, so far, but my inclination is to just execute the existing will. Let her have everything and perform her duties as both executor and sole beneficiary. Money-wise ..assets v. debts.. it will be a wash.. so that isn’t a factor.

Can anybody suggest why I shouldn’t just hunker down as a legal nobody in the current picture and let the original will probate out?

Wills / Trust / Probate ?

My question is that I heard that if you have a will and the estate goes to Probate, the state gets a big portion of the proceeds (assets) from the estate, is this correct?
Anonymous……..I am procoice based on individual circumstances (violant rapes, etc.) and that is exactly what I stated. I do not necissarly believe in abortion, but I still don’t like people telling me what I can and cannot do. If you reread my post, I believe I said I believe children born with health issues should be intitled to receive government aid. No where did I state I DONT BELEIVE IN HAVING CHILDREN W/ISSUES.
And why are you posting my words that you twisted here?
