family estate planning?
I am one of 5 children. One of my brothers is estranged from his ex wife, but they live together off and on. I have heard her say that she has supported him in the past (not sure if this is true). My question is does my brothers’s ex wife have any claim on the family estate? My brother will get his share (1/5). But she cannot claim a portion can she?

Does a Will avoid Probate?
My mother recently passed away. My sister lived with her and was taking care of her. She has a will my mother had made and she is the Executrix. We went to the attorney and he said we have to go through probate court and pay more fees. I thought a will would avoid probate. I have one other brother.

Legal Question about probate and will in IL?
My grandmother passed away in May of 07 and my aunt was declared executor, she didn’t file for probate until sept (4 months later) and now in January still nothing. When ever myself, my mother or my siblings try to contact her to find out what is going on she doesn’t answer our calls or return them. But my question is shouldn’t it be done and over with by now. No one has contested the will. Thank you
Also my uncle (my mom’s brother) is/has been living in my grandmothers house, this whole time.

Aunt's approx. $45,000 home. Do they need to probate will?
My wife’s aunt died and left my wife, her brother and her cousin sole heirs, ( by will), to her home and any incidentals. The home and everything probably are valued at approx. -50 thousand.
All they want to do is satisfy the tax debt and and recover our cost of upkeep for the house with the sale of home.
Everyone lives in Texas.

Does anyone out there know anything about Montana probate and will laws?
My mother-in-law passed away on September 29, 2007. She left no will. For the last 3 years we have taken care of Mom. Now his brother, who has had little contact with her for the last few years wants it all. There is also a brother who is mentally handicapped and who we promised to take care of. I need advise on wills after a death can anyone help?
My father passed away a few months back and his mother did a few months before. In her will it states that her children will share the money between them from the selling of her house, which mens my brother and I should get my fathers share to split between the two of us. Only now i’m hearing that someone who is not even related to the family has to sign over so my brother and i get my fathers share. My question is what does this woman have to do with my grandmothers will? Would it have any thing to do if my father would have signed it over in her name before his death? Understand this is very upsetting for me because this women was not even married to my father but actually someone else. I feel she only used him to clean up. Can anyone help me to understand wills and how it works?
The person who i am refering to use to be the executor of estate but gave it over to my fathers two sisters.
