Can an executor of Estate pocket some money for their own use???

Okay my wife’s mother-in-law recently passed away… in her last will and testament, she named my wife, her 2 sisters, and one grandson as beneficiaries of her life insurance… The executor is planning to use money to pay off some of the estate, which is fine I see how that can fit in to the setting… however… the executor is planning to also pull some money to pay for a truck that has no involvement with the estate of my wife’s late mother in law… Can the executor do this???

where can I view my grandmother's probated will?

My grandmother passed on May 22, 2007, before she passed she had left some money for me and two of my cousins. My family is not very good at communicating nor are they good giving money if they don’t know you are aware that you are to receive it. So to avoid friction I’ve done some research around my house and have found the attorney that probated the will, the docket number and probate court number. Although I’m uncomfortable questioning the attorney about the matter. Also the will was probated on July 11, 2007. With my grandfather noted as the independent executor what does that mean? And what steps will I need to take to see a physical form of the probated will by other means then going to my grandfather on this matter?

Can a piece of property supported by a will be placed in probate?

My wife’s grandfather passed away in March 2009, he had a will certified in 1993. The executor placed the property in probate instead of following the will. What can be done to remove the executor and retrieve all pertinent information about the property and execute the will properly?

a lawyer was named executor of my uncles estate, when he filed the petition for probate of will it list only the people involved in will and does not list the university and church he also included in will shouldn’t they be included?

Legal Question about probate and will in IL?

My grandmother passed away in May of 07 and my aunt was declared executor, she didn’t file for probate until sept (4 months later) and now in January still nothing. When ever myself, my mother or my siblings try to contact her to find out what is going on she doesn’t answer our calls or return them. But my question is shouldn’t it be done and over with by now. No one has contested the will. Thank you
Also my uncle (my mom’s brother) is/has been living in my grandmothers house, this whole time.

probating wills?

would i need my aunts signature to probate a house
i have my grandfathers will,and he left everything to my father.

Executor of Will — Cost of Probate — Foreclosure of deceased home?

I need some help. I am the Executrix/Executor of a family member’s Last Will and Testament. At the time of the decedents death, I was told that I had two years upon when I could probate. The cost was near ,500 (State of Texas) so I am told.

Due to financial set backs and the suffering economy I intermittently did and then again, did not have stable employment. I do not have the financial resources to probate the Will at this time and still have about 8 months before the two year deadline is in effect. I am now employed. Although I barely make ends-meet at this time, I do foresee that I will be able to save the probate cost by the time I must probate.

In the meanwhile, the bank upon which the mortgage is held is taking legal action against myself and the heirs — one of which is not even mentioned in the Will due to being estranged from the deceased for over 15 years. However, the bank has served them with papers stating that they (and I am) are being sued.

I really need some advice and guidance here. I most certainly want to do the right thing and get this Will probated. I’ve just had a very difficult time with income and employment for the last 14 plus months. The bank does need to recover its mortgage costs, however, I do not want the house in question — nor to I want to live in or rent out that property. The house is located in a town that I would NEVER live in.

What can I do to stop legal action against myself as well as the other two heirs listed in the suit. The Will stated that I am the recipient of familial heirlooms, etc. But, I am in no way affiliated with the mortgage.

Help?!?!?!

In order to sell the house, prior to foreclosure proceedings, I understood that I would have needed to put quite a bit of money back into the house to remodel etc to bring it up to sell’able and competitive standards. There are many houses in that particular neighborhood whose curb appeal, condition of property,etc were in better shape for a comparable price structure. I did not and do not have the funds to remodel the home to make this house compete with other houses in the same neighborhood and price range. Before the now deceased passed, I was told by the owner/deceased to "just let the house go back to the bank…." And, that’ is what I have tried to do. Now, the bank/mortgage holder is suing me….

I would be grateful for guidance here –

Not to be snarky….but please only reply if you have solutions because this is seemingly a serious situation I am in.

Do I need a probate attorney for this?

I recently married a widow that has an existing valid will, leaving everything to her only child daughter from the first marriage. After four months of marriage, my new wife died before we could revise the original will. Step-daughter has now expressed interest in trying to nullify the original will and making me, the new husband, the sole beneficiary. We have gotten along well, so far, but my inclination is to just execute the existing will. Let her have everything and perform her duties as both executor and sole beneficiary. Money-wise ..assets v. debts.. it will be a wash.. so that isn’t a factor.

Can anybody suggest why I shouldn’t just hunker down as a legal nobody in the current picture and let the original will probate out?

Missing will, probate and an evil cousin….. Help!!?

My Grandpa passed on the 15th October, he has savings and property which he said was left to me in his will. Suddenly a long lost nasty cousin has turned up out of the blue saying he is the executor dealing with Grandpas finances and that it has all gone to probate and that he did not leave a will. I believe the cousin stole grandpas keys to the house and car just before Grandpa died, as the car has gone!! and he is the only one with access to the house. The cousin said he has a meeting with the probate people??? and that I am not to attend, he has now changed his number so I can not contact him, I have no idea what to do now, I have called all the local solicitors who claim they have not got his will!! but this cousin knows a whol lot more than i do!!! any advise????? I have also registered with a missing wills website, who search for you. I have not advised the cousin of this!
