Your Questions About Writing A Will With A Lawyer

What is the best way to write a Will?
I have a friend who would like to write a will. She does not have a computer (or access to a computer) nor does she have lots of money to go a lawyer.
What is the best way for her to get it set up? Can *I* draw up her will on her behalf, either online or with a software program, send it to her to sign and get notarized and all that?
Note, that I am in Wisconsin, and she is in Maine. I don’t know if that makes a difference.

There are three ways that I know of without seeing a lawyer:
1) Web site like Legal Zoom.com or Nolo.com – you can go over the questions over the phone and have the document sent to her (cost $69 – $119).
2) Software like Quicken WillMaker Plus – Purchase and install on your computer, you can go over the questions over the phone and have the document sent to her (cost about $50)
3) Get a book to walk you through the process of making your own will (suggestion: Nolo’s Simple Will Book. Cost $25)
Personally, I would do #1 or #2 if you can afford it.

How do I find a lawyer who will take a case of work place harassment and be paid if we won.?
Accused of disobeying a direct order. Captain argued with is slepping with Project Manager. Previous employees have only received written discipline.

Lawyer will not paid us back?
When my grandmother passed in 2005 my dad hired a lawyer who charged him $1000 up font to settle the estate, the lawyer did very little and never returned are calls. About 9 months later my dad passed away. We went to a different lawyer that helped us settled the estates. We also wanted to get our money back from the bad lawyer. We went and filed a complaint threw our local bar association, and to the Supreme Court. We had a hearing with the bar association and before the hearing my mom and the bad lawyer signed a paper saying that the findings of the hearing were legal and binding. They awarded us $750 but that was in February of this year, we have never gotten any money. We called and written letters to the lawyers at the hearing but no one will help us, we even sent a letter to the president of the bar association and nothing. My mom paid an extra $100 to turn the judgment I believe into an order. He still will not pay us and the other lawyer that helped with the estates won’t help us anymore because he isn’t getting any money out of it. My question is who else can we go to? That will actually do something that will actually help us!!!

I hope your mom didn’t pay an extra $100 for that! A judgment and an order are the same thing. I would wait a little while longer. February was not that long ago. And to be honest, you may not get any money. People take people to court all the time. You can win, but it doesn’t mean you will get what you were awarded.

my question here is once we have the will in order, is a homemade will just as good as our lawyers 600.00 will, and finally where do we store the will,,,,,at home, a bank, church.etc…….thanks in advance.

Well good for you for thinking of doing a will . As for home made ones . The $600 one is the one to go for . Write down your wishes that you want done. The lawyer will do the necessary filing of the will and you can keep a copy at home but their will be a record of it with the lawyer. But times change and I would strongly advise that from time to time you review the will and change to suit the time and future needs. You hopefully not planing on popping off soon . So at a later date you may want to make provision for grandchildren one never knows. So dhow you have made a will keep it up to date every few years

Can you make a hand written will and what to include in a will ?
I am a 22 year old single mom of my 4 year old daughter. Her father is not involved what so ever. He doesn’t see her, support her, nothing. I have been meaning to make a will for the past 4 years but I haven’t gotten around to it. If I passed away, I would like my parents to get custody of her. My parents agree to take over responsibility if I pass away. And can I make a hand written will or should I go see a notary or my lawyer. I just want to make sure that she never ends up with her dad if I die. He has never seen her and has wished things that are so beyond comprehension that her being with him or his family is not an option. And what should I include in my will. I have a savings account for my daughter with almost 10 000 $ .. So how do I make sure she gets that money.

You would be COMPLETELY MAD! Not to seek wills/estates atty to prepare your will. There are things your parents need to sign to indicate their willingness to assume responsibility for your child. It’s NOT! Just a simple matter of getting your own thoughts down on paper. There is a GREAT DEAL of law involved here. Do it right the first time. If you don’t, your assets may escheat to the public administrator is s/he’s called upon to address a will that’s full of gaps ugh! …. A whole big mess of trouble. Don’t settle for a mere notary, either. When there are potentially contentious custody issues, notaries can’t advise. Again, do it right the first time and you’ll save everyone a WORLD! Of trouble if you die.
